Bon puisque c’est le branle bas de combat chez les auteurs aux Etats Unis, et sachant que nous sommes de plus en plus nombreux à exporter nos images, que le droit d’auteur a une certaine tendance à s’uniformiser par dessus les frontières dans la pratique et dans les textes, voici une petite note pour ceux qui ne serait pas encore au courant, sur le projet de lois du congrès américain sur les « Travaux orphelins », ou Orphan Works Bill. La lois devrait être votée cet été ce qui explique la réel mobilisation qui a lieu en ce moment outre-atlantique.
En quelques lignes, qui ont pour but d’informer pas de faire flipper (même si, oui c’est flippant), et qui me semblent concerner particulièrement les gens qui travaillent dans les Arts Appliqués puisqu’il me semble que tout graphiste ou illustrateur produit beaucoup d’images en une année et qu’elles ne sont pas forcément traçables.
Concernant les droits de la propriété intellectuelle, il est assez communément admis dans l’ensemble des pays de la planète que l’auteur d’une image (quelle qu’elle soit) dispose de fait de sa propriété (sans qu’il ait à faire une quelconque démarche). En cas de litige, du moment que vous pouvez prouver que vous êtes l’auteur d’une image, vos droits sont reconnus -et défendus-.
La loi dont il est question se veut, quant à elle, imposer une nouvelle façon de voir les choses…
Toute image crée, si elle n’est pas déclarée par son auteur, tombe dans la catégorie des “Travaux Orphelins”. Entendez : image sans auteur.
Ce qui veut dire, à l’instar des images qui sont tombées dans le domaine public, qu’elles appartiennent à qui en veut, à qui souhaite les exploiter à toutes fins. Il faudra donc déclarer désormais en amont la paternité de chaque image, et, autre délicat problème :cette déclaration sera payante !
Présenter ainsi voilà bien l’archétype de la loi scélérate. Car en effet, qui donc pourrait se payer le luxe de déposer chacune de ses images, de ses créations, sous toutes ses formes ? A notre échelle, personne, donc par conséquent : vive les quirielles d’images orphelines ! Et pour conclure un dernier point : l’origine de l’idée (mythe ou réalité?) viendrait de CORBIS et GETTY, deux énorme banques d’images libres de droit.
Je ne suis pas juriste (malgré de lointaines études), donc tout complément d’infos de gens plus au fait de tout ça est bienvenue.

In case of dispute, as long as you can prove that you are the author of an image, your rights are recognized and defended.
The law in question is willing to impose a new way of seeing things …
Any image created, if not declared by its author, falls into the category of “Works Orphans.” Hear: image without author.
That means, like the images that have fallen into the public domain, that they can belong to anybody who wants to exploit them for all purposes. Author will have to declare any upstream paternity of each image. Other delicate problem: you will have to pay for each statement !
This seems to be the archetype of a rogue law. For indeed, who could afford the luxury of deposit each of its images, its creations, in all its forms? So the consequence is an infinity of orphan images !To conclude a final point: the origin of the idea (myth or reality?) seems to be CORBIS and GETTY, two huge banks of free for use images.
I am not a lawyer (despite remote studies), so any additional information on this are more than welcomed.

La légende veut que Stills et Furay étaient bloqués dans un embouteillage à Los Angeles lorsqu’ils aperçurent un corbillard immatriculé dans l’Ontario, Neil Young s’en était servi pour passer la frontière en fraude, c’est ainsi qu’ils ont trouvé Neil Young, le nouveau membre dont ils étaient à la recherche pour fonder le groupe.
C’est aussi l’anniversaire de ma petite soeur…Bon anniversaire !

Première date de sa nouvelle tournée: Paris ! Et j’y était, trop contente que des amis m’y ait trainée au débotté. Entourée d’hommes musclés, d’anglais, d’australiens, de fans de la première heure et de jeunes couples, dont la moitié connaissait toutes les chansons par coeur…
Mention spécial pour la miss en robe rouge militaire, flottant dans les airs sur un crane géant ou pour « c’est trop joli ça », avec son accent.

Special mention to the Miss, in a red military dress, floating in the air on a giant skull, or “c’est trop joli ça ” with her Australian accent.
…personnelement j’ai travaillé, je sais ce n’est pas très civique mais que voulez vous en bonne freelance j’avais même oublié que c’était le premier mai, et qu’on était jeudi accessoirement, et que c’était férié par conséquent, enfin bref… et puis en plus c’est la période du bouclage comptable pour les impôts (être illustratrice ce n’est pas que dessiner, même si c’est quand même ce qu’on fait la plupart du temps) !

Today is the 1st of May… personally I worked, I know it’s not very civic, but what do you want, as a good freelance I had even forgotten that it was the first of May, and that it was incidentally Thursday, and that therefore it was holiday … and moreover it is the French period of accounting closure for income taxes (illustrator do not draw everytime, even if it’s still what we’re doing most of the time)!
So to celebrate the 1st of May with something as cute and as fresh as lily of the valley, a photo of baby otter found on Animal Discovery

Il y a en tout 6 T Shirts par 6 créateurs, chacun en édition limitée. Celui que j’ai fait reprend à la demande de l’équipe organisant l’évènement, un visuel personnel qu’ils ont beaucoup apprécié (j’ai juste modifié le sac qui a l’origine était un Dior).
Je suis super contente, cela fait longtemps que je rêvais de travailler sur du textile et des T Shirts, et je meurs déjà d’impatience de voir le T Shirt en vrai !

The Undiz staff chose one of my personal images they really appreciated for one T Shirt (I just modified the bag that was originaly a Dior one).
I’m so happy, I dream for a long time to work on textil and T Shirt, I can’t wait to see the final piece !

Voici 2 des 3 autres illustrations du Marie Claire de mai 2008 sur “L’éducation et les hommes”. Ici le “père trop cool” qui joue de la guitare au lieu des devoirs, tandis que la mère doit rectifier le tir, et le “tyran domestique” alors que la maman est dans la position de la mère consolante.
Here 2 of the other 3 illustrations I did for Marie Claire magazine France of May 2008. The subject was “Men and education of children”. Here the “too cool dad” who prefer playing the guitar instead of doing homework when the mother try to rectify her son’s attitude and the “domestic tyrant” when the mother is the consolating one.
